Welcome to OTR Designs, operated by NJ Moore Enterprises, LLC ("we," "us," "our"). By accessing or using otrdesigns.com (the "Site") and purchasing products from us, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By placing an order you represent that you meet this requirement.

2. Made-to-Order Products

Every OTR Designs item is produced just for you after you place your order. Production typically takes 2-7 business days before shipping. Because each piece is made individually, slight variations in color, placement, and material may occur and are not considered defects.

3. Pricing and Currency

All prices are listed in U.S. Dollars (USD). We reserve the right to change prices, descriptions, and product availability at any time without notice. Promotional pricing applies only to orders placed during the promotional period.

4. Orders, Acceptance, and Payment

Your order is an offer to purchase. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, product unavailability, or pricing errors. Payment is processed at checkout via Shopify Payments and approved alternative gateways. You authorize us to charge your selected payment method for the order total, including taxes.

5. Shipping

We currently ship within the United States only, including all 50 states, Washington D.C., APO/FPO military addresses, Puerto Rico, the U.S. Virgin Islands, and Guam. Shipping is included in the listed product price (no separate shipping charge at checkout). Delivery times are estimates; we are not responsible for carrier delays. 6. Returns and Refunds

Our Refund Policy is incorporated by reference. In summary, you may return any item within 14 days of delivery for any reason (extended to 30 days for items marked as gifts at checkout); return shipping is the customer's responsibility, and items must be unworn and unwashed. Defects, damage, or wrong items are covered for 30 days at no cost to you.

7. Intellectual Property

All designs, artwork, logos, photographs, copy, and other Site content are the property of NJ Moore Enterprises, LLC or our licensors, and are protected by U.S. and international copyright and trademark law. You may not reproduce, distribute, or create derivative works without written permission. Purchasing a product grants you the right to use the physical item; it does not transfer any rights in the underlying design.

8. User Content

If you submit reviews, comments, or other content to the Site, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, display, and distribute that content in connection with the Site and our marketing.

9. Disclaimers

THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, in no event will NJ Moore Enterprises, LLC, its officers, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or revenues, arising out of or related to your use of the Site or any product purchased. Our total liability for any claim is limited to the amount you paid for the product giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless NJ Moore Enterprises, LLC from any claim or demand, including reasonable attorneys' fees, arising out of your breach of these Terms or your violation of any law or third-party right.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of South Dakota, without regard to conflict-of-law principles. Any dispute will be resolved exclusively in the state or federal courts located in Minnehaha County, South Dakota, and you consent to personal jurisdiction there. The U.N. Convention on Contracts for the International Sale of Goods does not apply.

13. Changes to These Terms

We may update these Terms at any time. The updated version takes effect when posted. Your continued use of the Site after changes are posted constitutes acceptance.
